The introduction of administrative responsibility of the PI for failure to comply with the rules of transportation
Officials propose to finalize the administrative Code and introduce administrative liability of individual entrepreneurs for non-compliance with the rules of transportation of passengers, Luggage, heavy, bulky and dangerous goods.
During the meeting, the Government of the Russian Federation discussed amendments to the Code of administrative offences, which provide for an increase in the liability of individual entrepreneurs for non-compliance with road safety requirements. The relevant bill proposes to fine:
for violation of rules of a stop (Parking) of truck drivers on 5 thousand rubles, individual entrepreneurs — 100 thousand rubles;
violation of the requirements of fastening and placement of goods: drivers-1.5 thousand rubles, individual entrepreneurs-100 thousand rubles;
transport of heavy and bulky loads without a car cover in the motorcade: business entities — 300-400 thousand rubles;
violation of safety requirements for transportation of passengers and cargo: individual entrepreneurs — 200 thousand rubles.
Earlier, the government Commission on legislative activity explained that, in accordance with article 2.4 of the administrative Code, persons engaged in entrepreneurial activity without forming a legal entity and committing administrative offenses are equally responsible with officials. However, in this case, the fines stipulated for individual entrepreneurs is much lower than the fines for legal entities. If we talk about the safety of transport of passengers and cargo, then such inequality will be considered as invalid.
The press service of the Russian government reported that increased responsibility for non-compliance with the rules of transportation of passengers and Luggage, as well as heavy, bulky and dangerous goods should contribute to improving security. In the near future, the draft law is planned to be submitted to the state Duma of the Russian Federation for consideration.
